Anthony W. Ishii is a federal judge for the United States District Court for the Eastern District of California. He joined the court in 1997 after being nominated by President Bill Clinton. Ishii was the chief judge of the court from 2008 until 2012. Ishii is serving on senior status as of October 31, 2012.[1]

Education

Ishii graduated from Reedley Junior College with his bachelor's degree in 1966 and later earned a pharmacy degree at the University of the Pacific School of Pharmacy in 1970. He earned a J.D. degree from the University of California-Berkeley's Boalt Hall School of Law in 1973.[1]

Judicial nominations and appointments

Eastern District of California

On the recommendation of Senators Dianne Feinstein and Barbara Boxer, Ishii was nominated by President Bill Clinton on February 12, 1997, to a seat vacated by Judge Robert Coyle. Coyle assumed senior status at that time. Ishii was confirmed by the U.S. Senate on November 9, 1997, on a majority voice vote and received commission on November 14, 1997.[2] Ishii served as the chief judge from 2008 until October 31, 2012.[1] He assumed senior status on October 31, 2012.

Californians who want to buy a gun and have previously passed background checks no longer have to wait 10 days to complete the transaction. Brandon Combs, executive director of the Calguns Foundation, said that this ruling is a step in the direction of restoring Constitutional gun rights in California. He, several other individual plaintiffs and several organizations filed this lawsuit over two years ago.

Judge Anthony Ishii agreed with the plaintiffs that the waiting period serves no purpose once a person has already gone through the process of buying a gun previously. Ishii’s opinion, however, was specific in stating that his finding of unconstitutionality applies only to the 10-day waiting period for prior gun purchasers; it does not apply to first-time gun buyers. Further, while the plaintiffs raised two constitutional arguments, the obvious Second Amendment and a 14th Amendment equal protection argument, Judge Ishii only addressed the Second Amendment issue.

Plaintiffs pointed out that the state opted out of a federal program that would have allowed it to determine instantly if a person fails to pass the background check. California has had a waiting period of various durations on the purchase of firearms since 1923.
