Election rules

Primary election

Closed primary elections are held to allow members of political parties to select their respective candidates. The candidate who wins the Democratic primary, for example, will go on to be the Democratic nominee in the general election.[1] If a candidate cross-files, they could run in the general election as a Democratic Party candidate, as well as a candidate for one or more other parties.

According to statute, candidates for the supreme courts are chosen indirectly through delegates. Voters elect convention delegates in the primary election, and the delegates choose the supreme court candidates who will be on the general election ballot.[2][3]

The 324 justices of the New York Supreme Court are elected to 14-year terms in partisan elections. To appear on the ballot, candidates must be chosen at partisan nominating conventions. Sitting judges wishing to serve an additional term must run for re-election.[4]

The chief judge of the court of appeals appoints two chief administrative judges of the supreme court, one to supervise trial courts within New York City and one to supervise trial courts outside of the city.[4]

Qualifications
To serve on this court, a judge must:[4]

  • be a state resident;
  • have had at least 10 years of in-state law practice;
  • be at least 18 years old; and
  • be under the age of 70 (retirement at 70 is mandatory).

County courts

The 125 judges of the New York County Courts are elected to 10-year terms in partisan elections. To appear on the ballot, candidates must be chosen at partisan nominating conventions. Sitting judges wishing to serve an additional term must run for re-election.[4]

Qualifications
To join this court, a judge must:[4]

  • be a state resident;
  • be a county resident;
  • have had at least five years of in-state law practice;
  • be at least 18 years old; and
  • be under the age of 70 (retirement at 70 is mandatory).

Family courts

Judges of the New York Family Courts all serve 10-year terms but their method of selection varies based on location. Outside of New York City, they are selected through partisan contested elections. In New York City, they are appointed by the mayor. To serve on this court, a judge must be a state and county resident, at least 18 years old and practice in the state for 10 years. This court has a mandatory retirement age of 70 years old.[5]

Surrogates' courts

Judges of the New York Surrogates' Courts are each elected in partisan contested elections. Outside of New York City, they serve 10-year terms. In New York City, they serve 14-year terms. To serve on this court, a judge must be a state and county resident, at least 18 years old and practice in the state for 10 years. This court has a mandatory retirement age of 70 years old.[5]

Pivot Counties

Eighteen of 62 New York counties—29 percent—are Pivot Counties. Pivot Counties are counties that voted for Barack Obama (D) in 2008 and 2012 and for Donald Trump (R) in 2016. Altogether, the nation had 206 Pivot Counties, with most being concentrated in upper midwestern and northeastern states.

In the 2016 presidential election, Hillary Clinton (D) won New York with 59 percent of the vote. Donald Trump (R) received 36.5 percent. In presidential elections between 1792 and 2016, New York voted Democratic 45.6 percent of the time and Republican 35 percent of the time. In the five presidential elections between 2000 and 2016, New York voted Democratic all five times.[7]

The "Obama," "Romney," "Clinton," and "Trump" columns describe the percent of the vote each presidential candidate received in the district. The "2012 Margin" and "2016 Margin" columns describe the margin of victory between the two presidential candidates in those years. The "Party Control" column notes which party held that seat heading into the 2018 general election. Data on the results of the 2012 and 2016 presidential elections broken down by state legislative districts was compiled by Daily Kos.[8][9]

In 2012, Barack Obama (D) won 114 out of 150 state Assembly districts in New York with an average margin of victory of 46.5 points. In 2016, Hillary Clinton (D) won 99 out of 150 state Assembly districts in New York with an average margin of victory of 50.3 points. Clinton won four districts controlled by Republicans heading into the 2018 elections.

In 2012, Mitt Romney (R) won 36 out of 150 state Assembly districts in New York with an average margin of victory of 10.5 points. In 2016, Donald Trump (R) won 51 out of 150 state Assembly districts in New York with an average margin of victory of 17.6 points. Trump won 13 districts controlled by Democrats heading into the 2018 elections.
