Philip Martin Pro was an Article III federal judge for the United States District Court for the District of Nevada. He joined the court in 1987 after being nominated by President Ronald Reagan. He assumed senior status on December 31, 2011. Pro retired from the court on January 23, 2015.[1]

Education

Pro graduated from Contra Costa Community College with his associate degree in 1966 and received his bachelor's degree from San Francisco State University in 1968. He received his J.D. from the Golden Gate University School of Law in 1972. In May 2014, Pro earned an LL.M. in Judicial Studies from Duke University School of Law.[1][2]

Military service

Pro served in the US Navy Reserve from 1964 to 1968.[1]

Judicial career

District of Nevada

Article III judge

Pro was nominated to the District of Nevada by President Ronald Reagan on May 5, 1987, to a seat vacated by the impeachment of Judge Harry Claiborne. Pro was confirmed by the Senate on July 22, 1987, and received commission on July 23, 1987. He served as chief judge from 2002-2007. He assumed senior status on December 31, 2011 and retired on January 23, 2015.[1]

Magistrate judge

Pro began his federal judicial career in 1980 and was appointed to a full eight-year term as a federal magistrate judge in the United States District Court for the District of Nevada. Pro served as a magistrate judge for seven years before being elevated in the ranks of the federal judiciary in 1987.[1]

In Righthaven v. Hoehn, Pro ruled that the republishing of an entire article without permission from the rights holder was acceptable.

Wayne Hoehn copied the entirety of an editorial from the Las Vegas Review-Journal onto a website of which he was a user, medjacksports.com. Righthaven argued that this act reduced the number of viewers the article would have received during the time that it was reprinted. Pro ruled that "Righthaven did not present any evidence that the market for the work was harmed by Hoehn’s noncommercial use for the 40 days it appeared on the website. Accordingly, there is no genuine issue of material fact that Hoehn’s use of the work was fair and summary judgment is appropriate."[3]
