The terms of two West Virginia Supreme Court of Appeals justices expired on December 31, 2024. The two seats were up for nonpartisan election on May 14, 2024. The filing deadline was January 27, 2024.
With a total of nine justices on the Supreme Court of Appeals of West Virginia, one justice ran for re-election without opposition and one seat on the court was open. Justice Haley Bunn was unopposed to retain her Division 1 seat and Charles S. Trump IV in the Division 2 race was unopposed for the May 14, 2024 election. As of May 2024, three judges on the court were appointed by a Republican governor, while one was first elected in a partisan election as a Republican. One judge was also elected in a nonpartisan election.[1]

The West Virginia Supreme Court of Appeals is the state's court of last resort. This means it is the state's highest court, and its rulings are not subject to review by any other court except in cases that fit the proper conditions for review by the United States Supreme Court. There are five justices on the court.

Selection

Each of the five justices on the Supreme Court of Appeals of West Virginia serves terms of 12 years. In the case of a vacancy, the governor appoints a replacement from a list of two to five qualified applicants submitted by a nominating commission.[2] The appointee serves until the next general election, at which point he or she may compete to fill the remainder of the unexpired term.[3]
Qualifications
To serve on the West Virginia Supreme Court of Appeals, a judge must be:
- a citizen of West Virginia for at least five years;
- at least 30 years old; and
- practiced in law for at least 10 years.[3]
