It is an offence to distribute or threaten to distribute an intimate image(s) of a person without their consent (colloquially known as ‘revenge porn’) and you may be charged under the Criminal Law Amendment (Intimate Images) Act 2018 (WA).

The Courts have the power to make a rectification or ‘take down’ order in relation to the image(s).

There are two ways to report, depending on the circumstances:

  1. Criminal complaints: call police on 131 444 or in person at your local police station.
  2. Non-criminal complaints: use the eSafety Commissioner’s online complaints portal. The Commonwealth eSafety Commissioner also has authority to order the removal of an intimate image from social media, the internet, or any other electronic service if it was posted without consent.  

Any person over 10 years of age can be charged if they commit a criminal offence in WA, including intimate image offences.
